| It’s official, the Department of Climate Change and Energy Efficiency has recently announced that disclosure requirements under the Commercial Building Disclosure program (CBD) will commence on 1 November 2010. The Building Energy Efficiency Disclosure Act 2010 commenced on 1 July 2010 and is being implemented through the Commercial Building Disclosure program – a national scheme designed to improve the energy efficiency of Australia’s large office buildings. Under the program, from 1 November 2010 most sellers or lessors of office space of 2,000m2 or more will be required to obtain and disclose an up-to-date energy efficiency rating. There is a transition period for the first year of the program where a valid National Australian Built Environment Rating System (NABERS) Energy base or whole building rating can be disclosed. During the transition period, from 1 November 2010 to 31 October 2011, if a NABERS Rating cannot be issued under the NABERS Validation Protocol the building owner may apply for an exemption. However, it is likely any exemption would be a one-off and those issues preventing a NABERS Rating being provided will need to be rectified in time to produce a Building Energy Efficiency Certificate on or after 1 November 2011. This means building owners should act now to ascertain if any issues are present which may prevent buildings receiving a NABERS Rating, and immediate steps taken to rectify those issues. From 1 November 2011 a full Building Energy Efficiency Certificate (BEEC) will need to be disclosed. BEECs are valid for 12 months, must be publicly accessible on the online Building Energy Efficiency Register, and include: > a NABERS Energy star rating for the building > an assessment of tenancy lighting in the area of the building that is being sold or leased and > general energy efficiency guidance. The NABERS Energy star rating must also be included in any advertisement for the sale, lease or sublease of the office space.
